Unlike your creditors, your employer will not get a notice of your bankruptcy case. However, bankruptcy is a public proceeding, which means that members of the public who are not a party to your bankruptcy can look at your bankruptcy case. They can usually do this online, using the PACER system. The question is why would someone go digging around to find out if you’ve ever filed bankruptcy? It’s unlikely that your employer spends time going through bankruptcy records to see if you’ve filed. If an employer reviews credit reports in making hiring decisions, then they will obviously see your bankruptcy.
Also, federal law prohibits employers from discriminating against someone based on their filing bankruptcy. If you think that your employer has discriminated against you because you filed bankruptcy, you should talk to an attorney.
