As you probably know by now if you’ve been reading this blog, when you file bankruptcy, you’re guaranteed to have to make one visit to the bankruptcy court here in Colorado. That will be the meeting of creditors, or 341 meeting. The trustee runs the meeting, and will ask you a series of questions. In the typical case, this takes all of about five minutes. However, it can run longer if he sees anything out of the ordinary in your case.
When you are called for your time in front of the trustee, the trustee will swear you in. You have to promise to tell the truth when you answer his questions. He will also be making an audio recording of your answers.
Most of the questions you’ll be asked are yes or no questions. And that is exactly how you should answer them. It isn’t necessary or required for you to provide any more information than you’re asked for. You should only give the information he asks for. That doesn’t mean you should avoid answering any questions, but you should remember that the trustee is not your friend. His job is to take care of the creditors.
