If you can not afford Chapter 7 filing fees, you may qualify for a fee waiver. The court may waive the fee only if your income is less than 150 percent of the official poverty line applicable to your family size and you are unable to pay the fee in installments.
Your bankruptcy attorney will need to complete Official Form 3B and file it with your petition. You will have to disclose your income and expenses, property that you own, anyone who owes you money, and other information.
The court will then make a decision as to whether or not you qualify for the fee waiver. In some instances, the court may schedule a hearing to learn more about your request. If your request is denied, you may still be allowed to pay the filing fee in up to four installments. If you are offered the opportunity to make installment payments, and fail to make all of the payments, your case may be dismissed.
