For instance, one of these attorneys – someone who claims to be an expert – explicitly excludes from his representation the following things:
- Motions to void judgment liens – If you own a home and a creditor has filed a judgment lien, it is absolutely critical that you have these removed in the course of your bankruptcy. Otherwise, when you’re ready to sell your home, you’ll have to pay off the creditor, which absolutely negates filing bankruptcy in the first place.
- Dealing with creditor harassment – One of the primary reasons my clients come to me is to deal with collector harassment. I can’t imagine telling a client that I would not make sure this stops, doing whatever is necessary.
- US Trustee inquiries – How this attorney can even exclude this is beyond me. If your attorney fails to respond to an inquiry from the US Trustee, the simple fact is that your case could get dismissed.
- Amending the bankruptcy petition – If you have omitted creditors or forgotten to include any assets, your attorney must file an amendment. Again, refusing to amend the petition could lead to your case being dismissed.
